When you access Service with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

- to allow you to participate in interactive features of our Service when you choose to do so;
- to provide customer support;
- to gather analysis or valuable information so that we can improve our Service;
- to monitor the usage of our Service;
- to detect, prevent and address technical issues;
- to fulfill any other purpose for which you provide it;
- to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
- to provide you with notices about your account and/or subscription, including expiration and renewal notices, email-instructions, etc.;
- to provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information;
- in any other way we may describe when you provide the information;
- for any other purpose with your consent.
Our Roles: Controller and Processor
For the personal data of our own customers (your account, billing, marketing, and support data), SiteGPT is the Data Controller.
For the data your chatbots ingest and collect (trained content, end-user conversations with your chatbot, and leads captured by your chatbot), SiteGPT acts as a Data Processor on your behalf: you are the controller of that data, we process it only on your instructions, and our Data Processing Agreement governs that processing. If you chat with a SiteGPT-powered chatbot on another company's website, that company is the controller of your conversation and their privacy notice applies; we will refer any privacy request you send us about such data to them and assist them in fulfilling it.
Lawful Bases for Processing (GDPR Article 6)
Where GDPR applies, we rely on the following lawful bases:
- Contract: providing your account, workspaces, chatbots, and support (account data, authentication, billing administration).
- Legal obligation: retaining billing and tax records.
- Legitimate interest: first-party analytics to understand and improve the Service, service communications, and fraud/abuse prevention. Our product analytics (PostHog) associates usage events with your account and may record sessions on our website and dashboard to diagnose issues and improve usability; contact us to object or opt out.
- Consent: marketing emails where consent is required. Every marketing email includes an unsubscribe link, and you can withdraw consent at any time.
Retention of Data
We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.
In practice: account data is kept for the life of your account and deleted through our deletion cascade when the account is deleted; chatbot content, conversations, and leads are kept until you delete them or delete the chatbot or account (in HIPAA-enabled workspaces, conversation content is additionally redacted automatically on the retention schedule in the applicable Business Associate Agreement); billing records are retained as required by tax and accounting law even after account deletion; analytics and observability logs age out on our providers' retention schedules.
Transfer of Data
Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. If you are located outside United States and choose to provide information to us, please note that we may transfer the data, including Personal Data, to United States and process it there.
Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
SiteGPT will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy, and no transfer of your Personal Data will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.
Our service providers are primarily located in the United States. Where personal data of EU/EEA or UK residents is transferred to them, we rely on the European Commission's Standard Contractual Clauses and, where the provider is certified, the EU-U.S. Data Privacy Framework. The safeguards for each provider are listed with our subprocessor list, and the Standard Contractual Clauses we offer our customers are part of our Data Processing Agreement.
Disclosure of Data
We may disclose personal information that we collect, or you provide:

Please note that we may ask you to verify your identity before responding to such requests. Please note that we may not be able to provide Service without some necessary data.

We will verify your identity (normally by corresponding through the email address on your account) and respond within one month; if a request is complex we may extend by up to two further months and will tell you why within the first month. There is no charge for making a request unless it is manifestly unfounded or excessive.
We do not make decisions based solely on automated processing that produce legal or similarly significant effects about you.

Your Data Protection Rights under the California Privacy Protection Act (CalOPPA)

Analytics and Advertising Measurement
We use the following analytics and measurement providers on our website:

- PostHog measures how the product is used. If you hold an account, usage events are associated with your account (including your email address and name), and PostHog may record sessions on our website and dashboard to diagnose issues and improve usability, with passwords, email and phone inputs, and sensitive values such as API keys masked before anything leaves your browser. Session recording does not run inside the chat widget or hosted chat pages.
- DataFast measures our marketing site (page visits and conversion goals) using a first-party identifier, and associates activity with your account once you sign up.
- Dub measures referral and affiliate link conversions.
